Terms and conditions

Provision of Marine Personnel:

1. Client to indemnify and hold harmless MHLP in respect of any damages to or loss of property owned by client, its contractor and/or their respective personnel. MHLP to indemnify and hold harmless Client in respect of any damages to or loss of property owned by MHLP, its Contractor and/or their respective personnel.

2. Client to indemnify and hold harmless MHLP, its Sub-contractors and their respective personnel against injury to or death of any of Clients’ and its other Subcontractors’ employees (even in case of negligence) and MHLP indemnifies and hold harmless Client, its Subcontractors and their respective personnel against injury to and death of MHLP’s and/or its subcontractors’ employees (even in case of negligence).

3. Notwithstanding any provision in the contract, Client and MHLP shall indemnify and hold harmless each other fully in respect of all losses, damages, costs and claims which are related in any way to the performance of the agreement and which are made by third parties, other than those referred to in sub. 1 and 2 above.

Engineering and Consultancy Services:

MHLP performs engineering and consultancy services in accordance with the regulations laid down in RVOI – 2001, valid worldwide except in USA and CANADA. RVOI provides rules governing the relation between client and consulting engineer, issued by the Royal Dutch Society of Delftqualified engineers (Chamber of commerce Rotterdam 23082677)

These regulations limit the liability to the contract sum for engineering and consultancy services in order to make good. MHLP can not accept any further liability, including also consequential damages.

USA and CANADA:

For work in the USA and CANADA, MHLP has to be fully indemnified and held harmless by client in all respects for  the provision of personnel and for the provision of engineering and consultancy services. MHLP has to be coinsured on client’s insurance policy where possible, or has to be considered as such.
Dutch Law applies unless otherwise agreed in advance.
